Refund and Return Policy

1. Return/Refund Application In accordance with the terms and conditions of this Refund and Return Policy and the Terms of Service, buyers may apply for returns and/or refunds before Depopshop expires the warranty period specified in the Terms of Service. Depopshop guarantee is a service provided by Depopshop at the request of users to assist users in dealing with certain conflicts that may arise during the transaction process. Users can communicate with each other privately to resolve differences, or contact local authorities to help them resolve any disputes before, during or after using Depopshop.
 

2. Return application The buyer can only apply for refund and/or return under the following circumstances:
• The buyer did not receive the item;
• Goods are defective and/or damaged on delivery;
• The Seller delivers items to the Buyer that do not conform to the agreed specifications (e.g. wrong size, color, etc.);
• The items delivered to Buyer differ materially from the description provided by Seller in the item listing; or
• By private agreement with the seller, the seller must send his/her confirmation to Depopshop to confirm such agreement.

Buyer applications must be submitted through the Depopshop mobile app.

Please note that if requested by Depopshop, the buyer must ship the item to a location designated by Depopshop within ten (10) calendar days of making the return request.

Depopshop will determine whether to approve your refund and return request at its sole discretion. Buyer acknowledges and agrees that Depopshop's decision is final, conclusive and binding, and undertakes and agrees not to litigate or otherwise assert any claim against Depopshop or its affiliates with respect to such decision.


If the Buyer has initiated legal action against the Seller, the Buyer may provide Depopshop with a formal notice from the relevant authorities requiring Depopshop to continue to hold the purchase funds until a formal decision is obtained. Depopshop will determine, in its sole discretion, whether it is necessary to continue to hold funds for such purchases.


3. The right of priority sellers

If you are a Preferred Seller, you should receive separate written notification from Depopshop that you have elected to participate in the Depopshop Preferred Seller Program. If you decide at any time not to participate in the Depopshop Preferred Seller Program, please notify Depopshop in writing; otherwise, you will be deemed to have elected to continue participating in the Depopshop Preferred Seller Program and to have agreed to the terms and conditions set forth in this Refund and Return Policy. Depopshop may suspend or remove any Preferred Seller from the Depopshop Preferred Seller Program at any time in its sole discretion.

Depopshop’s decision to approve a refund or return of an item in accordance with Section 2 above shall be binding on the relevant Preferred Seller. Preferred Sellers agree to comply with and take all necessary steps to effectuate Buyer's refund or return requests approved by Depopshop.

For any refund or return request approved by Depopshop, Depopshop will notify the Preferred Seller by email ("Email Notification") and organize the sending of the relevant Returned Goods in writing to the address provided to Depopshop by the relevant Preferred Seller for completion Refund and return procedures, provided that the address is located in the country where the relevant item is sold on the Website (the "Local Address"). If the Preferred Seller fails to provide a local address for the returned Goods or fails to accept delivery of the returned Goods within a reasonable period of time (as determined by Depopshop), Depopshop reserves the right to dispose of such Goods in any manner it deems appropriate, and the Preferred Seller shall All rights to such items are deemed to have been waived. If the Returned Items are not received by the Preferred Seller, the Preferred Seller must notify Depopshop within seven (7) days of receipt of the email notification (the "Notification Period"). Failure to notify Depopshop within the notice period will be conclusive evidence and result in the Preferred Seller accepting that the item was delivered and the Preferred Seller agrees not to make any claim or enter into any dispute with respect to any such item.

Notwithstanding the foregoing, items approved for refund or return in Depopshop's sole discretion may not be returned to the Preferred Seller, and the Preferred Seller shall be deemed to have forfeited all rights to the item.

For any refund or return where the relevant Goods have been received by Depopshop and rejected by Depopshop, Depopshop will organize shipping of the Goods to the relevant Buyer’s address in accordance with Section 2 above.

If Depopshop approves any refund or return request, the Preferred Seller may appeal such decision by contacting Depopshop and providing evidence to support such appeal. If Depopshop supports the preferred seller's appeal, it will pay all or part of the purchase price to the preferred seller. Preferred Seller acknowledges and agrees that the decisions of Depopshop are final, conclusive and binding and covenants and agrees not to litigate or otherwise assert any claim against Depopshop or its affiliates with respect to such decisions.


4. Rights of ordinary sellers

For the purposes of this refund and return policy, a regular seller is a seller who is not a marketplace seller or preferred seller.

When Depopshop receives a return and/or refund request from a buyer, Depopshop will notify the seller in writing. The seller may respond to the buyer's application according to the steps provided by Depopshop in the written notice. Seller must respond within the time frame specified in the written notice (the "Prescribed Period"). If Depopshop does not hear from the seller within the stipulated period, Depopshop will assume that the seller has not responded to the buyer's application and will continue to evaluate the buyer's application without further notice to the seller. Depopshop will review each seller's response on a case-by-case basis and determine, in its sole discretion, whether a buyer's application is likely to be successful based on the circumstances described by the seller.

5. Return conditions

In order to have a hassle-free experience when returning an item, Buyer should ensure that the item, including any free items such as accessories that come with the item, must be returned to Seller in the same condition that Buyer received upon delivery. We would advise buyers to take photos of the item upon receipt.

6. Responsibility for product return shipping costs i) In the event of an unforeseen error by the Seller (i.e. - damaged, defective or incorrectly delivered product to the Buyer), the Seller will be responsible for the Buyer's return shipping costs. (In the event that the buyer changes his or her mind, the buyer should obtain the seller's consent before making a return request, and the buyer will bear the return shipping costs.) In the event of a dispute between the buyer and seller regarding the party responsible for the return shipping costs, Depopshop will make its own decision The party responsible for return shipping costs.

7. Refunds The buyer will only receive a refund after Depopshop receives confirmation from the seller that the returned goods have been received. If Depopshop does not hear from the Seller within the specified time, Depopshop will be entitled to refund the applicable amount to the Buyer without further notice to the Seller. Refunds will be made to the buyer's credit/debit card or nominated bank account, whichever is applicable.

8. Communication between buyers and sellers
Depopshop encourages users to communicate with each other if there is a problem with a transaction. Since Depopshop is a platform for users to conduct transactions, buyers should contact sellers directly to resolve any issues related to their purchases.
